A California consumer has filed a proposed class action lawsuit against Gatestone & Co. International, Inc. claiming the defendant's collection letters are unlawful.
A California consumer has filed a proposed class action lawsuit against Gatestone & Co. International, Inc. claiming the defendant’s collection letters fail to comply with the Fair Debt Collection Practices Act (FDCPA) and California state law. The plaintiff alleges that he received a letter from Gatestone that contained a statement of his rights under the FDCPA, but was incomplete and failed to clearly and accurately communicate FDCPA requirements. The “defective notice” allegedly neglected to inform the recipient of his right to dispute or obtain verification of the debt, thereby causing the letter to be considered an “unfair or unconscionable means to collect or attempt to collect a debt,” according to the suit.
