A blind Bronx, NY resident claims furniture retailer Modani's website is not fully accessible and independently usable by visually impaired consumers.
Mondani New York, LLC is facing a proposed class action that alleges the furniture retailer’s website, Modani.com, is not fully accessible and independently usable by blind and visually impaired consumers and thusly violates the Americans with Disabilities Act (ADA). The lawsuit, filed by a blind Bronx resident, claims Modani.com, in addition to being “heavily integrated” with the defendant’s physical store locations to the extent it should be subject to the ADA, is incompatible with screen-reading software used by blind people to navigate the Internet. The plaintiff argues blind individuals, as a result of the access barriers on Modani.com, “have been and are still being denied equal access to Modani’s furniture retail stores,” in that proposed class members cannot access information concerning locations and hours of operation, sales, and furniture specs online.
