A proposed class action has been filed against Full Circle Financial Services, LLC over claims that the defendant violated the Fair Debt Collection Practices Act by attempting to collect an unauthorized fee.
New York
A proposed class action has been filed against Full Circle Financial Services, LLC over claims that the defendant violated the Fair Debt Collection Practices Act (FDCPA) by attempting to collect an unauthorized fee. The case says the plaintiff received a collection letter that demanded a $3.95 “convenience fee” in addition to submitted payments. The suit argues that this extra charge was “neither expressly authorized by the agreement creating the debt, nor permitted by law,” rendering it illegal under the FDCPA.
