The 14-page lawsuit says that the popular video streaming service has “knowingly” violated the Video Privacy Protection Act (VPPA), which prohibits “video tape service providers” from disclosing data about consumers’ video viewing behavior without prior consent. Through the use of “sophisticated tracking technology,” FuboTV collects and transmits to third parties information that may be used to identify individual subscribers, including their locations, device details and the content and videos they have viewed on its platform, the suit claims.
Per the case, the defendant’s privacy policy readily “admits” that the company discloses the data it collects to affiliates, subsidiaries and third-party advertisers that use the information for targeted marketing.
The complaint contends, however, that “at no point” does FuboTV acquire its subscribers’ written consent to share their data in any capacity, as required under the VPPA.
“By disclosing its subscribers’ [personally identifiable information], which undeniably reveals both an individual’s identity and the video materials they have requested from [FuboTV’s] services, [the defendant] has intentionally and knowingly violated the VPPA,” the filing charges.
The plaintiff, a FuboTV subscriber residing in Illinois, says she often watches video content on the streaming service. By doing so, the woman’s private data was collected and transmitted to third parties in violation of her federally protected privacy rights, the case alleges.
The lawsuit looks to represent anyone in the United States with a FuboTV account that they used to view video materials at any time since August 9, 2021.
