From Wisconsin district court comes a proposed class action claiming Frontline Asset Strategies, LLC violated the Fair Debt Collection Practices Act (FDCPA) with the debt settlement offer it made to the plaintiff. The suit also names as a defendant Bureaus Investment Group Portfolio Number 15, LLC, which purchases and receives assignments of defaulted consumer debts after they’re acquired by Frontline.
According to the case, the defendants sent a collection notice to the plaintiff with an offer to settle her debt for 74 percent of the total owed. In this communication, the defendants indicated that payment should be received by January 4, 2017. The plaintiff claims this purportedly limited-time settlement offer was made in violation of the FDCPA because, in truth, there is no time limit on which the plaintiff could send in payment. The misleading time limit for the settlement, the plaintiff argues, was included in the collection notice only to impart a sense of false urgency upon the consumer.
