Frisbid Services, LLC is the defendant in a proposed class action out of Florida. The plaintiff claims the auto care center operator violated the Telephone Consumer Protection Act (TCPA) by using automated dialing technology to send unsolicited text messages to consumers without consent to do so. Some of the numbers that received texts from the defendant are included in the National Do-Not-Call registry, the suit says.
The plaintiff claims he began receiving texts from Frisbid Services in early July 2018. The short-coded messages encouraged the plaintiff to “Get a $12.50 Oil Change before you take off on your summer destination!” according to the complaint. The suit notes the number from which the messages were sent belongs to non-party CallFire, Inc., a company that provides text and voice calling marketing solutions.
“At no time did [the plaintiff] ever provide consent for [the defendant] to send [the plaintiff] marketing text messages,” the case reads.
