Fortegra Financial Corp. and Ensurety Ventures, LLC (which does business as Omega Autocare) are on the receiving end of a proposed class action alleging violations of the Telephone Consumer Protection Act (TCPA). The plaintiff in the case claims he received several calls from the defendants that were placed using autodialing technology and attempted to solicit his business. He argues that he never consented to receive telemarketing calls and that his number had been listed on the National Do Not Call Registry. As a result, the suit alleges, the defendants’ behavior violated the TCPA and caused the plaintiff “annoyance and an unnecessary expenditure of his time and efforts.”
