A proposed class action seeks to take automotive warranty underwriter Fortegra Financial Corporation and Ensurety Ventures, LLC, a warranty administrator that does business as Omega Auto Care, to task over what the plaintiff says is an automated calling operation through which thousands nationwide have allegedly received unsolicited robocalls. The plaintiff claims he never contacted either defendant for any purpose before he received his first call from Omega Auto Care in May 2017. The man says the call he received from the defendants was placed using automated dialing technology, evident by the “substantial pause at the beginning of the call prior to a human voice coming on the line.”
“[The defendants] are, or should have been, aware that the automated calling operation marketing their warranties was placing telephone solicitation calls in violation of the [Telephone Consumer Protection Act],” the complaint reads.
