Fortegra Financial Corporation and Ensurety Ventures, LLC (which does business as Omega Auto Care) are on the receiving end of a proposed class action lawsuit alleging Telephone Consumer Protection Act (TCPA) violations. The complaint claims the defendants, who respectively underwrite and administer automotive warranties, illegally placed telemarketing calls to consumers’ cell phones using automated dialing technology.
According to the suit, the plaintiff received a call advertising the defendants’ services despite never having provided his prior consent to receive the call or entering into any sort of business relationship with the companies. The case is seeking injunctive and monetary relief for the plaintiff and proposed class members.
