Forster & Garbus, LLP; two of the firm’s individual attorneys; Navient Solutions, Inc.; Navient Solutions, LLC; and SLM Private Credit Student Loan Trust 2006-C have been named in a proposed class action out of New York federal court that accuses the defendants of unlawful debt collection practices.
In September 2017, the case says, Forster & Garbus, with Navient’s authority and on behalf of SLM, filed suit against the plaintiff in an effort to collect on an outstanding student loan debt. The following October, the case continues, the plaintiff was served with a “deceptive” and “misleading” summons regarding the lawsuit.
“Plaintiff suffered injuries as a result of the deceptive or misleading actions including but not limited to the aforementioned violations of his rights under the [Fair Debt Collection Practices Act], the cost of retaining an attorney to defend him, and the emotional distress of being sued,” the suit charges.
