A proposed class action filed in New York Tuesday alleges Forster & Garbus LLP broke federal debt collection laws by sending a collection letter to the plaintiff that failed to note whether the man’s balance may increase due to interest or fees. The case alleges this conduct, which shows up quite frequently in Fair Debt Collection Practices Act (FDCPA) lawsuits, may leave the unsophisticated consumer unsure as to whether his or her debt would be fully satisfied by paying the stated balance in a collection notice.
