Three former employees of Lincare Holdings, Inc. have filed a proposed class action lawsuit against the company over claims that its negligence in protecting their personal information led to a data breach and the resulting risk of identity theft.
Three former employees of Lincare Holdings, Inc. have filed a proposed class action lawsuit against the company over claims that its negligence in protecting their personally identifiable information (PPI) led to a data breach and the resulting risk of identity theft. The complaint explains that on February 3, 2017, a Lincare Human Resources employee sent names, email addresses, Social Security numbers, salary information, and other protected data of current and former employees to a third-party purporting to be a senior-level executive. The suit argues that Lincare should have taken precautions against attacks like these and was obligated to protect its employees’ personal information. The complaint says that, as a result of the defendant’s alleged negligence, the plaintiffs and proposed class members were subjected to various types of identity theft, including tax fraud, false student loan applications, and fraudulent credit applications.
Moreover, the suit argues that in response to the breach, the defendant offered inadequate solutions and “squarely placed the burden on [the plaintiffs and proposed class members]” to take measures to protect their identities, monitor their credit, and resolve criminals’ fraudulent attempts to use their information.
