A lawsuit alleging AMN Healthcare, Inc. performed unlawful background checks has been recently removed to California federal court.
A lawsuit filed against AMN Healthcare, Inc. in September 2018 has been recently removed to California federal court. The proposed class action alleges the company routinely performs background checks on prospective and current employees without properly obtaining permission to do so.
The plaintiff—who worked for the company from June to September 2013—alleges the defendant failed to issue a “clear and conspicuous disclosure” in a stand-alone document informing the woman of its intention to run a background check before procuring the report. Instead, the case continues, the company supposedly included the notice in a three-page form with other “extraneous and superfluous” information.
Moreover, the suit charges the defendant failed to apprise the plaintiff of her rights under the Fair Credit Reporting Act, such as the ability to dispute any inaccuracies in her report.
