A consumer from New York has filed a proposed class action against Forever 21 claiming the retailer breached the Telephone Consumer Protection Act (TCPA) by sending advertisement text messages without prior consent. The plaintiff claims she received the automated texts through the WeChat texting app, which utilizes consumers’ personal phone numbers. Because WeChat uses consumers’ cell phone numbers and is not an internet-only text app, it falls within the boundaries of the TCPA, the lawsuit notes.
The proposed class encompasses anyone who has received unsolicited texts through WeChat or conventional texting services from Forever 21 sent using an automated dialing system within the last four years.
