The complaint, initially filed in March and amended on April 3 in California, alleges defendant Synergy CHC Corp.’s claims about the benefits of FocusFactor have been “proven false by overwhelming scientific evidence.” The supplements, touted as “Nutrition for the Brain” and consisting of “patented and clinically tested formulas,” fail to provide any of the advertised benefits and are mislabeled in violation of California law, the case contends.
The plaintiffs, two California residents described as consumer advocates and “testers” working to ensure that companies abide by state law, say they purchased FocusFactor from a Los Angeles CVS based on the “promised results” and advertised benefits.
The consumers allege that the defendant’s efficacy claims for FocusFactor are “not simply unsubstantiated, they have been proven false” by scientific evidence that includes numerous studies that prove the supplements “do not and cannot [provide] the promised benefits.”
According to the filing, Synergy CHC Corp. has “illegally collected millions of dollars from unsuspecting consumers.”
The suit looks to cover all persons in the United States who bought FocusFactor supplements for personal use within the last three years.
