Advertising platform Fluent, LLC and subsidiary Reward Zone USA, LLC are facing a proposed class action over their alleged practice of sending unsolicited text messages to consumers’ cell phones without consent. According to the lawsuit, the defendants not only send consumers unsolicited text messages to drive business—texts that the plaintiffs say are generated through automatic dialing software—but then “dupe consumers into providing their cell phone numbers,” which are then sold as leads to Fluent and Reward Zone’s customers. These customers, the case continues, then send consumers more unsolicited texts.
