A new class action filed in Florida claims defendant Robert Binns Roofing violated the Fair Labor Standards Act’s overtime and minimum wage requirements. The plaintiffs, two former roofers for the company, claim the defendant did not pay them for time spent reporting to the shop, loading work vehicles and generally preparing for the day. According to the complaint, workers were not considered “on the clock” until they headed out to their first job site. Additionally, the plaintiffs say that although they were regularly unable to take lunch breaks, lunch time was still deducted from their time spent on job sites. Similarly, plaintiffs added Robert Binns Roofing failed to pay them for time spent driving from the job site back to the shop.
