The operators of a Subway in Yonkers, New York have been hit with a class action alleging the sandwich makers violated the Fair Labor Standards Act (FLSA) and state labor laws by failing to pay proper overtime and spread of hours wages. The suit claims TMS Food & Catering Inc. did not pay the plaintiff time-and-a-half overtime and spread of hours wages—owed in New York to employees who work shifts longer than 10 hours—even though he worked an average of 98 hours per week.
