A class action has been filed against SER Security Services Incorporation alleging the company failed to pay its security officers overtime wages.
A class action has been filed against SER Security Services Incorporation alleging the company failed to pay its security officers overtime wages. The plaintiff claims the company misclassifies the workers as independent contractors, thereby skirting its obligation to pay payroll taxes, workers’ comp insurance, health insurance, overtime and other benefits typically available to employees. Despite the independent contractor title, the plaintiff—who reportedly worked between 60 and 70 hours a week for the company without overtime pay—says the defendant controlled its workers’ schedules and determined the manner in which employees trained and reported to superiors.
