A Florida woman has filed a proposed class action lawsuit against Garcia Paez, P.A. and Joseph A. Garcia alleging violations of the Fair Debt Collection Practices Act. The plaintiff claims the defendant sent or “caused to be sent” a written correspondence, often referred to as a “dunning letter,” allegedly in connection with an auto loan she took out to finance a 2010 Nissan Altima. The suit claims letters sent to the plaintiff and other proposed class members were “reasonably calculated to confuse or frustrate consumers with respect to advising consumers” as to their rights regarding the validation of consumer debts.
