A Florida man’s lawsuit against Quicken Loans claims that the company violated the TCPA by sending unsolicited promotional messages to his cell phone.
A Florida man’s proposed class action against Quicken Loans, Inc. claims that the company violated the Telephone Consumer Protection Act (TCPA) by sending unsolicited promotional messages to his cell phone.
In September 2018, the plaintiff began receiving texts from the defendant advertising a health insurance service, the suit says. The case alleges that the man never gave his consent to be contacted and didn’t have any relationship with the company before receiving the messages. Further, the texts supposedly failed to include opt-out notices, which are required under the TCPA. The suit argues that the messages were a nuisance to the plaintiff and caused him to incur additional data charges from his cell phone carrier.
