A Florida consumer has named Chipotle Mexican Grill, Inc.; Chipotle Services, LLC; and Chipotle Mexican Grill of Colorado, LLC as defendants in a proposed class action in which the man claims the companies are responsible for unsolicited mass text messages sent in violation of the Telephone Consumer Protection Act (TCPA). The plaintiff claims he received at least five unsolicited texts from Chipotle beginning in November 2017 as part of a marketing campaign. The messages, the lawsuit says, offered various deals, discounts and savings, and promoted Chipotle’s new mobile app, yet were supposedly sent without consent from recipients. Moreover, the plaintiff mentions, only two of the five texts he received reportedly contained language instructing recipients on how to stop receiving the texts.
