A proposed class action filed against Bonita Springs Acquisition, LLC, which operates Florida car dealership Bonita Springs Mitsubishi, alleges the company violated the Telephone Consumer Protection Act (TCPA) by using prohibited auto-dialing technology to call consumers’ cell phones without consent. The lawsuit claims the defendant, on at least two occasions, called the plaintiff’s cell phone for non-emergency purposes, with the calls utilizing a prerecorded voice message to market sales events at the dealership and encourage the plaintiff to buy a car.
