Braman Hyundai, Inc. is on the receiving end of a proposed class action lawsuit that alleges it violated the Telephone Consumer Protection Act (TCPA) by placing pre-recorded telemarketing calls to consumers’ cell phones without their prior consent. The plaintiff says the defendant used auto-dialing technology to leave a message on his cell phone that advertised its services and attempted to “dupe” him into visiting its car dealership. He claims he never consented to receive the call, which the suit says was placed “with no regard for consumers’ privacy rights,” and argues that it was illegal under the TCPA.
