A lawsuit claims Credit Control, LLC misled a Florida consumer regarding her right to demand verification of a debt.
Credit Control, LLC is the defendant in a Florida consumer’s proposed class action that claims the debt collector misled her about her right under the Fair Debt Collection Practice Act (FDCPA) to demand verification of a debt. The lawsuit alleges the defendant, in its demand letter sent to the plaintiff in December 2016, unlawfully failed to inform the plaintiff “of what they need to notify the defendant’s office of, i.e. that they need to dispute the debt or any portion thereof, as opposed to, for example, writing to notify [Credit Control] that the consumer cannot afford to make any payment on the debt.” More specifically, the complaint claims the defendant did not inform the plaintiff as to what exactly she needed to do to notify Credit Control that she was disputing the amount of debt or to receive verification of the debt or a copy of a judgment.
