The 11-page proposed lawsuit alleges that by failing to honor consumers’ requests to opt out of receiving its texts, the company has violated the Telephone Consumer Protection Act—a federal law designed to safeguard individuals from unwanted telemarketing communications.
Per the suit, SoulCycle continued to “bombard” the plaintiff with unwanted text messages even after the man replied “Stop” to opt out. The case contends that this demonstrates the company has illegally failed to maintain an internal do-not-call list.
Moreover, the complaint claims the defendant lacks a written policy about its telemarketing practices and has failed to provide adequate training to marketing personnel.
As the filing tells it, SoulCycle’s allegedly illegal conduct has likely disrupted the “daily life of thousands of individuals.”
The lawsuit looks to represent anyone in the United States who, in the past four years, received a text message from SoulCycle, or an agent acting on its behalf, on their residential telephone number after making a request to no longer receive texts.
