A proposed class action alleges Nestlé Health Science U.S. has misled millions of consumers by overstating the cardiovascular health benefits of its Nature’s Bounty fish oil supplements.

According to the 24-page lawsuit, the Nature’s Bounty supplement labels feature overt claims about supporting cardiovascular health, including a prominent representation on the front of each bottle that states, “Heart Health.” However, the suit claims the label representations are misleading, as studies show there is “no proof that fish oil supplements improve heart health at all.”
When a consumer sees the product’s label—which sometimes includes additional claims that the supplement “Promotes Heart & Vascular Health,” “May Reduce Risk of Coronary Heart Disease” and “Supports Heart & Immune Health”—they are reasonably led to believe that taking the fish oil pills will have cardiovascular health benefits, the case contends.
As such, the labeling is deceptive because “[n]o reasonable consumer reads those words and expects that the supplement has no effect on heart health,” the complaint argues.
The plaintiff, a New York resident, claims to have purchased Nature’s Bounty fish oil supplements numerous times in the past because he believed that they were “good for his heart.” The filing relays that the man would not have paid as much for the supplements, or bought them at all, had he known they have “no effect on heart health” and are, instead, “wholly worthless.”
The lawsuit looks to represent anyone in the United States who purchased Nature’s Bounty fish oil supplements during the applicable statute of limitations period.
