A New York man has filed a proposed class action lawsuit against Firstsource Advantage, LLC claiming the debt collector violated the Fair Debt Collection Practices Act by failing to clearly specify the amount of his alleged debt.
A New York man has filed a proposed class action lawsuit against Firstsource Advantage, LLC claiming the debt collector violated the Fair Debt Collection Practices Act by failing to clearly specify the amount of his alleged debt. The plaintiff allegedly received a collection letter from the defendant that included an “account balance,” but neglected to disclose whether the balance was static or whether it would increase due to interest or other fees. According to the lawsuit, this ambiguity is illegal under the FDCPA as it hinders the consumer from being able to fully settle his or her account.
