Per a consumer's lawsuit, Firstsource allegedly failed to state whether a man's debt balance may increase due to accruing interest or late fees.
Firstsource Advantage, LLC is the defendant in a proposed class action in which the plaintiff claims the company failed to note in a collection notice that his balance may increase due to the accrual of interest, late fees or other charges. Moreover, the plaintiff, citing possible Fair Debt Collection Practices Act (FDCPA) violations, claims the defendant also failed to state what parts of his alleged debt are respectively attributable to principal, interest and late fees. These alleged failures, the lawsuit charges, would render the plaintiff, under the FDCPA’s “least sophisticated consumer” benchmark, unable to determine not only the minimum amount due as of the collection letter’s creation, but how much needs to be paid to resolve the debt at any given point in the future.
