FirstCollect, Inc. is on the receiving end of a proposed class action lawsuit alleging the company failed to comply with the Fair Debt Collection Practices Act. The plaintiff in the suit says she received a letter from the debt collector that stated:
“Effective February 1, 2015 all partial payment accounts will be charged a $4.00 partial payment fee for each payment received.”
The suit argues that the defendant had no legal authority to collect an extra “partial payment fee” and that this conduct violated federal law.
