A New York consumer claims in a proposed class action lawsuit that defendant Financial Recovery Services, Inc. violated the Fair Debt Collection Practices Act (FDCPA) when it failed to clearly state in a collection notice the amount of debt he owed and whether it would be accruing interest and/or fees. According to the lawsuit, the defendant’s conduct could leave an unsophisticated consumer uncertain as to whether the stated amount owed may increase due to accrued interest. Similarly, upon payment, the unsophisticated consumer may be left unsure as to whether the entire debt had been paid or if it was still accruing undisclosed interest or fees.
