Financial Recoveries, Inc. (which does business as Oshkosh Collection & Recovery) is facing a proposed class action lawsuit that claims the defendant sent a Wisconsin consumer a misleading debt collection letter.

Financial Recoveries, Inc. (which does business as Oshkosh Collection & Recovery) is on the receiving end of a proposed class action lawsuit that claims the defendant sent a Wisconsin consumer a misleading debt collection letter. According to the case, the letter attempted to collect a medical debt on behalf of Horizon Healthcare Inc. and was addressed “to the responsible party (which may be one or both of the above addressees) for the following accounts.” The suit notes that there was only one addressee listed above the statement and that the plaintiff was confused as to whether another person was also responsible for the alleged debt since the letter does not name the person to whom medical services were provided.
“[The plaintiff] does not recall engaging in any transactions with Horizon for medical services for himself or for any of his minor children,” the complaint explains. “[The plaintiff] has joint custody for [sic] one minor child and was confused as to whether the medical services may have been provided pursuant to an agreement between the provider and the child’s mother.”
The suit argues that the letter confused the plaintiff and was intended to pressure him into paying “a debt for which there was no evidence as to his liability.”
