A proposed class action claims Financial Asset Management Systems, Inc. failed to clearly identify a consumer’s creditor in a collection letter and was therefore unauthorized to collect the threatened interest and fees.
The plaintiff says he received a letter from the defendant that ambiguously identified his creditor as “Emory Healthcare Provider.” According to the case, there are “hundreds of healthcare providers” in the Emory Healthcare System, and the letter failed to specify to which entity the plaintiff was indebted.
Further, the lawsuit claims the defendant was unauthorized to collect “interest, late charges, and other charges” on behalf of the purported creditor because “no such individual or entity exists.”
