In what’s seemingly becoming a bi-weekly occurrence, FCA US LLC and Fiat Chrysler Automobiles have been hit with a proposed class action claiming the companies defrauded consumers and duped the Environmental Protection Agency by allegedly gaming federal emissions testing for EcoDiesel branded light trucks and SUVs. The lawsuit, which comes from California district court, alleges the defendants equipped test vehicles with a “defeat device” software algorithm capable of adjusting the cars’ emissions controls to ensure they would pass. As a result of the defendants’ alleged conduct, the lawsuit argues, proposed class members were induced into buying or leasing vehicles that did not perform as represented, violated the federal Clean Air Act and polluted the environment at levels “far in excess” of what is allowable by law.
