Cummins, Inc. and FCA US LLC are facing a lawsuit alleging they 'recklessly disregarded' that certain 'clean diesel' vehicles lacked adequate emissions controls.
Cummins, Inc. and FCA US LLC are facing a class action lawsuit alleging they “recklessly disregarded” that certain “clean diesel” vehicles lacked adequate emissions controls during normal driving conditions even though the cars were advertised to be more eco-friendly and fuel-efficient than standard gas vehicles. According to the 710-page complaint, plaintiffs say the defendants’ deceptively advertised “clean diesel” engines were sold under the false pretense that they were more environmentally friendly than those found in gas vehicles. Plaintiffs claim that, unbeknownst to consumers, “clean diesel” vehicles were equipped with faulty emissions systems that turned off or limited emission reduction capabilities during normal driving conditions while simultaneously emitting pollutants at levels much higher—and much more environmentally harmful—than those produced by regular gasoline-powered cars.
“The defendants never disclosed to consumers that the affected vehicles may be ‘clean’ diesels in very limited circumstances, but are ‘dirty’ diesels under most driving conditions,” the lawsuit says.
