FDS Bank and Department Stores National Bank (DSNB) have been named as defendants in a proposed class action lawsuit alleging that they unlawfully used an autodialing system to place calls to consumers’ phones without their prior consent.

FDS Bank and Department Stores National Bank (DSNB) have been named as defendants in a proposed class action lawsuit alleging that they unlawfully used an autodialing system to place calls to consumers’ phones without their prior consent. According to the suit, the plaintiff received calls from the defendants over a four-year period, even after he “repeatedly pleaded” that the calls cease. He says the calls were made through the defendants’ “consumer-facing brand Macy’s” and that he never consented to receive the calls. The suit argues that the calls invaded the plaintiff’s privacy and occupied his phone line in addition to being “annoying” and “a nuisance.”
