Professional Placement Services, LLC is on the receiving end of a proposed class action lawsuit alleging the defendant violated federal debt collection law by failing to clearly convey a consumer’s amount of debt.

Professional Placement Services, LLC is on the receiving end of a proposed class action lawsuit alleging the defendant violated federal debt collection law by failing to clearly convey a consumer’s amount of debt. The plaintiff, according to the complaint, received a letter from the debt collector that stated the following:
“While the amount above is your total balance as of the date of this letter, the total balance on the day you pay may be greater as a result of fees and interest that continue to accrue.”
The suit argues that simply informing the plaintiff his balance may increase does not comply with the Fair Debt Collection Practices Act’s requirement that debt collectors clearly state the amount of debt. By failing to provide additional information – such as the interest rate, date of accrual, and nature of any added fees – the defendant attempted to instill in the plaintiff a sense of urgency that would result in his prompt payment of the alleged debt, the suit says.
