Merchants & Professional Credit Bureau, Inc. is facing a proposed class action lawsuit filed by a Texas woman who claims the defendant sent her a collection letter that violated the Fair Debt Collection Practices Act (FDCPA). The letter allegedly informed the plaintiff that she had “time remaining within the 30 day notification rule” to dispute her purported debt and then warned her that she “still [had] an opportunity” to prevent the debt from showing up on her credit report.
The suit claims the defendant’s insistence that the plaintiff pay her debt quickly overshadowed the included information explaining her right to dispute the debt or request validation.
“The letter is threatening,” the complaint argues, “and was sent with the intent of scaring Plaintiff into making payment and preventing her from making a dispute request during the full 30 day time period.”
