Nationwide Credit, Inc. is on the receiving end of a proposed class action that claims the defendant sent a debt collection letter that violated the Fair Debt Collection Practices Act (FDCPA).
Nationwide Credit, Inc. is on the receiving end of a proposed class action that claims the defendant sent a debt collection letter that violated the Fair Debt Collection Practices Act (FDCPA). According to the complaint, the letter stated the following:
“The Account Balance as of the date of this letter is shown above.”
The suit argues that the letter falsely implied to the plaintiff that the balance of his debt may change. “The sole purpose” of the statement, the complaint alleges, “was to coerce the Plaintiff into paying immediately” even though his account was not subject to interest or fees.
