National Enterprise Systems, Inc. is the defendant in a proposed class action lawsuit that claims the debt collector violated the Fair Debt Collection Practices Act (FDCPA) by demanding that consumers submit debt disputes in writing. The plaintiff in the case says he received a collection letter instructing him to “forward all payments and correspondence to” a physical address. According to the complaint, since a dispute is considered a “correspondence,” a consumer could be misled into believing he or she must submit a written dispute when the FDCPA also allows for oral disputes.
