Atlantic Credit & Finance Inc. is facing a proposed class action that accuses it of violating the Fair Debt Collection Practices Act (FDCPA) by failing to clearly identify a consumer’s creditor.

Atlantic Credit & Finance Inc. is facing a proposed class action that accuses it of violating the Fair Debt Collection Practices Act (FDCPA) by failing to clearly identify a consumer’s creditor. The plaintiff says she received a collection letter from Atlantic that noted her “Original Creditor” as “CITIBANK, N.A.” and her “Current Creditor” as “MIDLAND FUNDING, LLC (MID).” Yet, further down, the letter allegedly represented that the defendant had purchased the plaintiff’s account and claimed that Atlantic “is entitled to be paid the balance due of $1,357.05.”
The suit argues that upon reading the letter, the plaintiff was unsure as to whom she owed the alleged debt due to the apparent contradictions.
