ARStrat, LLC is facing claims that it sent a New York consumer a collection letter that contained false statements in violation of the Fair Debt Collection Practices Act (FDCPA). The plaintiff says she received a letter from the debt collector titled “Second Notice” that informed her it had already sent a “first notice” containing a description of her rights under the FDCPA. The suit alleges that these representations were false and that the “Second Notice” letter was the defendant’s initial communication with the plaintiff. As a result of the letter’s alleged misstatements, the case argues, the plaintiff was unsure as to whether the 30-day validation period was over during which she could dispute the debt or request verification.
