Mercantile Adjustment Bureau, LLC is on the receiving end of a proposed class action lawsuit that alleges the debt collector violated the Fair Debt Collection Practices Act (FDCPA). The plaintiff says he received a collection letter from the defendant that stated, in part: “The account balance may periodically increase due to the addition of accrued interest as provided in your agreement with the original creditor or as otherwise provided by law.” The complaint claims the defendant unlawfully failed to include information the plaintiff needed to calculate the true balance of his debt on a given day, despite federal law, i.e. the FDCPA, mandating such information be communicated clearly and unambiguously.
