A proposed class action has been filed in New York against American Coradius International, LLC after the company allegedly violated provisions of the FDCPA.

A proposed class action has been filed in New York against American Coradius International, LLC after the company allegedly violated provisions of the Fair Debt Collection Practices Act in its debt collection letters. The plaintiff says he received a letter from American Coradius that specified an “account balance” of $79.95. The complaint argues this amount does not indicate whether the balance includes interest or whether any additional interest will accrue if no payment is made, and the letter allegedly fails to note when payment is due. The suit further argues that the unsophisticated consumer could not be certain as to whether a payment equaling the “account balance” would actually settle the account. The proposed class includes anyone in the state of New York who received a letter from the defendant similar to the plaintiff’s letter that attempted to collect a personal debt and was not returned by the postal service.
