New York
A New York man has filed suit against United Collection Bureau, Inc. claiming the defendant failed to adhere to the Fair Debt Collection Practices Act’s requirement that debt collectors clearly communicate a consumer’s amount of debt. According to the complaint, the defendant sent the plaintiff a collection letter that listed his “Current Account Balance,” but failed to indicate whether the amount was increasing due to interest or other fees. The complaint argues that the plaintiff’s account was, in fact, accruing interest, as evidenced by an earlier collection letter that specified a lower balance. Therefore, the case alleges, the defendant should have provided the plaintiff with the information he needed to calculate the amount he truly owed.
