Debt collection unit I.C. System, Inc. and MD Now Medical Centers are staring down a class action alleging they violated the Fair Debt Collection Practices Act (FDCPA) and Florida consumer protection laws. The 20-page complaint details claims that, after receiving treatment at an MD Now facility, I.C. System (which was brought in to collect the unpaid balance) demanded the plaintiff pay both his unpaid balance and an extra “20% gratuity fee.” The complaint notes the plaintiff paid both of these amounts in full and on time.
According to the suit, I.C. System ignores contractual language put forth by MD Now that permits only the medical facility to collect the actual cost of patients’ balances and instead illegally attempts to recover a gratuity fee calculated based on a percentage of the unpaid balance. The suit mentions that, to date, I.C. system has been the subject of more than 1,100 complaints filed by consumers to the Credit Financial Protection Bureau.
