Out of Wisconsin comes a proposed class action that alleges defendant Source Receivables Management, LLC violated the federal Fair Debt Collection Practices Act (FDCPA). The plaintiff alleges the North Carolina-headquartered defendant sent a collection notice over a debt allegedly owed to Sprint that falsely implied the settlement offer contained therein would only be valid if the first payment was made by a certain date. The lawsuit argues the defendant’s conduct in the notice is deceptive because the settlement offer, contrary to what the letter indicated, is available to the plaintiff at any time and not tied to any deadline.
Moreover, the defendant allegedly instructed the plaintiff to review the reverse side of the notice of an explanation of certain policies, procedures and privacy rights. The lawsuit claims the reverse side of the collection notice in question was blank.
