A class action out of New Jersey says Simon's Agency breached the Fair Debt Collection Practices Act (FDCPA) in its communications with consumers.
A class action out of New Jersey says Simon’s Agency breached the Fair Debt Collection Practices Act (FDCPA) in its communications with consumers. Filed on behalf of a minor child by her guardian, the 21-page lawsuit claims the debt collection agency sent a letter to the plaintiff that illegally misrepresented the past-due debt amount, with one sum listed under the “Amount” column and a completely different number listed under “Total Account Balance.” The FDCPA, the suit notes, views this as a deceptive representation that could cause the unsophisticated consumer to be unsure of the exact amount of debt owed.
