A New York woman claims in a proposed class action that defendant Northland Group Inc. violated the Fair Debt Collection Practices Act (FDCPA) in the course of its conduct with consumers. The plaintiff claims the defendant, in a collection notice “open to one of multiple interpretations,” failed to disclose whether her balance owed may increase due to interest and/or fees, as well as correctly state the full amount of debt owed.
“A reasonable consumer could read the notices and be misled into believing that he or she could pay her debt in full by paying the amount listed on the notice,” the lawsuit argues.
