Debt collection outfit National Enterprise Systems, Inc. is facing a class action lawsuit claiming the company sent collection letters to alleged debtors without disclosing whether owed balances may increase due to accruing interest and fees. The complaint alleges collection letters sent by the defendants did not include safe harbor language, as mandated by the Fair Debt Collection Practices Act (FDCPA). An unsophisticated consumer, the lawsuit claims, could incorrectly assume that he or she is paying their balance in full when the actual amount owed includes undisclosed interest and fees.
